Spousal Coverage
(Tax Law)
Health coverage that is available through the employer of the eligible individuals spouse. In order for the plan to be qualified for the HCTC Program, the spouses employer must contribute less than 50% of the total cost of coverage for the spouse, the HCTC eligible person, and any dependents (0% if you qualify under ATAA). Any share of the premium that is paid by the eligible individual or the eligible individuals spouse on a pre-tax basis is considered to have been paid by the employer and must be included as such when determining the percentage of employer coverage. This type of coverage can only be claimed on your federal tax return and not in advance, except for spousal COBRA coverage.
